NOTICE
OF INTENT TO MAKE PHONOGRAPH RECORDS:
Producers and
artists or anyone wanting to record a song by a publisher that
is not under compulsory license (a song that’s been recorded by
the original songwriter or released with permission of the
publisher or songwriter to the public falls under compulsory
license) all others, must notify the publisher, before releasing
the song or manufacturing mechanical objects, such as:
phonograph records/CD’s/Cassette Tapes, digital downloads, etc.
Notice must be made 30 days prior to or 30 days after release,
preferably 30 days prior to release, so a Mechanical License can
be granted, or negotiated. No notice, mandates automatic
payment of the statutory rate at the current rates set and
established by the copyright laws of the United States.
